DWI Laws:

If you receievd a DWI and your BAC was tested using an Alcotest machine, you may be able to have your sentence stayed pending the decision in State v. Chun. Contact us for further information regarding this decision.

If you received a third or subsequent DWI, you will be required under Michael's Law (NJSA 39:4-50) to serve 180 days in jail. 90 days of that sentence may be served in a drug or alcohol inpatient facility. While the 90 days of rehabilitation must be served in an inpatient facility (see State v. Luthe), depending on the jurisdiction where you received your DWI you may be able to serve the 90 days of jail time on a non-consecutive basis (i.e. weekends).
